TERMS OF SERVICE

Welcome to Gotham Rugby Football Club (“Gotham,” “the Club,” “we,” or “us”). These Terms of Service govern participation in Gotham Rugby and use of our services, programs, events, and communications. By becoming a member or participating in Club activities, you agree to these Terms.

Membership Scope

These Terms apply to all members of Gotham Rugby Football Club, including players, social members, volunteers, coaches, and board participants. Membership is a privilege extended by the Club and may be revoked in accordance with the Club bylaws.

Participation in Club activities constitutes acceptance of these Terms.

Assumption of Risk & Insurance

Rugby is a full-contact sport that carries an inherent risk of injury, including serious injury. By participating in Gotham activities, members acknowledge and accept these risks.

All playing members are required to maintain active registration with USA Rugby and its Club & Individual Participant Program (CIPP) or successor program. This registration includes supplemental insurance coverage for injuries sustained while participating in sanctioned rugby activities.

Except where prohibited by law, Gotham Rugby Football Club, its officers, directors, coaches, volunteers, and affiliates are not liable for injuries or damages arising from participation in Club activities.

Members are responsible for their own personal health insurance and medical decisions.

Conduct & Discipline

Members are expected to uphold the values and mission of Gotham Rugby.

Disciplinary matters are governed by the Club bylaws. The Board of Directors may take disciplinary action when a member engages in conduct materially and seriously prejudicial to the interests or purposes of the corporation.

The Board’s determination and resulting action — including suspension or expulsion — shall be final and binding, subject to any procedures outlined in the bylaws.

Membership Dues & Payments

Seasonal dues are required for participation in rugby activities. Dues are set each season based on anticipated Club expenses and operational needs.

All dues are nonrefundable, except in the event a member is expelled from the Club. In such cases, prepaid seasonal dues will be returned on a prorated basis.

Additional fees (e.g., tournaments, travel, apparel, or special events) may apply and will be communicated separately.

Failure to pay required dues may result in suspension from participation.

Media Release & Public Activities

Gotham Rugby may photograph or record Club activities for use in social media, marketing materials, promotional content, and Club communications.

Members grant the Club the right to use their likeness, image, and voice in such materials without compensation.

The Club will make reasonable efforts to honor individual requests to avoid media use. However, Club activities occur in public spaces where no expectation of privacy exists, and Gotham cannot guarantee exclusion from incidental photography or recording.

Privacy & Communications

The Club collects and maintains basic member information for operational purposes, including communication, scheduling, registration, and safety.

Gotham does not sell personal information. Member data is shared only with service providers necessary to operate the Club (e.g., payment processors, registration platforms, league organizations).

Members consent to receiving Club-related communications.

Changes to Terms

Gotham may update these Terms from time to time. Continued participation after updates constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of New York.
